Humanity has finally realised that the way we do things need to be changed and improved in order to save the planet. We believe that as a web studio we need to do our part as well. So how can websites be sustainable? 

On average viewing a web page generates about 20 mgs of CO2 per second on desktop computers. This number goes up to about 300 mgs per second when viewing a website with complex media files. Watching movies through a rich media web page for a couple of hours could generate around 1kg of greenhouse gases. That doesn’t sound like much, but with a billion page views here and there it begins to add up

Here is what we do to tackle the issue: 

  1. All our websites are mobile friendly and responsive. Viewing a website on mobile device leaves a smaller CO2 footprint. 
  2. We are in the process of swapping our servers to the ones that only use renewable energy

An SSL Certificate is like a security gate to your business. When you purchase an SSL certificate, the research company checks the references and approves that your business is what you say it is. When that is approved you also get data encryption which means that when your customer puts any data into your website on his/hers computer it gets ‘scrambled” on its way to the server where your website is.Then, when it is there, it gets “descrambled”. That way no one can access your clients’ personal details on the way to the server. 

If your website requires any type of personal information from the customer you definitely need to have an SSL certificate. If you don’t ask for any details it would still make sense to get it for 2 reasons: 

Trust. Most browsers will warn the person landing on a website if it is secure or not. When someone sees a “Not secure” statement they instantly lose trust in the website. That is even before they decide to put any personal details in. It is purely psychological, but it is true. 

It can have an effect on your Google ratings. Google prioritises websites with an SSL certificate and puts them higher up the ranks. 

You can check if you have an SSL Certificate by looking at the beginning of your website address.

Website hosting is necessary for you to be able to have a website. It is as simple as if you want to build a house you need to purchase land for that house to sit on. Your website is stored on a server and when someone wants to access it they type in your URL and get redirected to that part of the server. The bigger your website, the more functions it has – the more space you need. Therefore, the cost of hosting increases. 

We run the very latest servers to keep high speeds & our systems are always kept up-to-date. If there are any issues we deal with the technicians and having all the techy-geeky talks. 

Hosting is something you have to pay for yearly. If you do not renew your hosting, your website will not have the “land” to sit on.

As a business owner, sometimes you are so busy with other things that it is hard to notice that your website isn’t up to date anymore. So here are 10 signs to keep an eye out for!

Flash animation alert. Most browsers do not support flash anymore so people will most likely not see it anyways. Even if they do see it, it is considered to be very annoying these days. 

Your website loading time is too long. People are not used to waiting anymore. If they have to wait, they most likely will just leave the website and go somewhere else.

Mish-mash fonts and backgrounds. Old websites used to have smaller fonts, bright colors and backgrounds. This is not the case anymore. People prefer stylish and minimalistic designs. Pick a maximum of 2-3 fonts and colors for your whole website.

People can’t figure out what you do within the first 5 seconds after landing on your page. 

The link with your email address automatically opens Outlook. It puts people off these days. Best to have a contact form that is linked to your email. 

Your photos are outdated or used by many other websites. No comment here,\ as photos reflect on what you do. Even if they are just photos of you and your employees they can’t be 10 years old, even if back than you looked like a God/Goddess 

It is not responsive and does not look good on most of the popular devices. When we launch a website we always check how it looks on mobile, Windows and Mac (P.S. we even remember the times, when we just started out. We did not have a Mac and were running around our neighbours’ houses to see if they had one) 

No social media integration. Even if you do not update your Facebook and Instagram pages often (which you totally should), as a bare minimum you need to have a social media link button to your profile. Better if you have a live feed on there as well. 

Broken pages are a “No No” in 2019! There is simply no excuse for it. People get frustrated if the page they want to click on comes up with an Error

High bounce rate means that people see your website in search, but leave it very quickly because they simply do not like it. You can check your bounce rate once you have signed into your Google Analytics account

A one page website is your business card. This is a bare minimum requirement of a good online presence. Whether you are a computer geek or still figuring out how to use Facebook this is a MUST HAVE. We don’t just say it because this is what we get paid to do. We say it because not having a website can turn some potential customers away from you. One of the first things people do is checkout the website. These days if a business doesn’t have one, we naturally question ourselves, if we can trust this business. 

So even if you are just starting out, think about at least a one page simple website. Is it enough for a successful business? You are not going to like this answer, because IT DEPENDS. Depends on many various factors, such as the complexity of your business model. If you are an online shop, probably one page is not enough, however, if you are a local cake maker, dance teacher, etc. this will be plenty to start with. 

Now the important part of why you should hire someone to do this for you. If you only have one page to impress someone it has to be absolutely stunning. This is the priority of quality over quantity. The page has to be simple, yet modern and stylish, representing who you are, showing that your business has character. Whatever company you decide to go with, make sure that they understand you and your goals and are excited about it as much as you are.

These Terms relate to Morfett Designs & Craig Morfett Design S.L. which are both trading assets.

All hosting is paid from the originally scheduled start date until the end of the year & will be added to the total cost of the website build fee or billed separately, whichever is more convenient to the client.

Hosting Fees Per Year are paid annually every January, where applicable & are subject to a yearly 3% increase minimum due to inflation; prices are charged in GBP due to our 3rd party supplier, and other currencies are updated to the exchange rate every three months.

Hosting must be paid in full in January; non or late payment will render services being restricted & withheld, and a fee of £150 *minimum will be charged to reconnect services. (any data lost due to disconnection of services is not our responsibility; if a hosting bill is not paid within 30 days of the due date or a website is canceled, all assets become the property of Morfett Designs, and we reserve the right to re-sell, destroy or operate, Domains – Hosting – Emails – Branding and Logos or Coding.. this list is an idea of the type of assets not an exhaustive list of inclusions. In the rare situation where we allow clients to pay a monthly fee for their assets, the same 30-day rule applies as above.

An admin fee of £75 is charged per account to backup & transfer website files. £250 is charged to back up and transfer emails & contacts. Domain Transfer is free of charge (unless premium fees are applied)

At any point, a client can request to receive their website as a zip file & transfer their domain to a receiving account; there is a small £75 charge to cover processing fees to do this per request, we do not backup emails as part of this process, and there is no support included.

    1. All estimates/quotes are based on our understanding of your requirements and as per the given time frame. Any changes to the functionality, including micro-improvements, may incur additional costs accordingly. Please ensure and clarify our understanding in a face-to-face, phone, or video call meeting.
    2. By accepting a quote from Morfett Designs, you agree to and accept our Terms & Conditions. Acceptance may be provided verbally, via email, through payment of an initiation fee, or by signing a quote. Morfett Designs reserves the right to update these Terms & Conditions at any time. It is the client’s sole responsibility to review and stay informed of any updates, and Morfett Designs is not obligated to notify clients of changes.
    3. Charges for services provided by Morfett Designs are defined in the invoice the client receives via email.
    4. Clients to ensure that we have included all requirements in the quotes/proposals/estimates and that we fully understand their needs.
    5. Any complexity related to specific tasks must be advised in advance and included in the proposal for costing purposes. We operate in good faith and rely on our clients to disclose the whole picture at the time of quotation. Morfett Designs will not bear any discrepancy arising due to unclear requirements.
    6. Morfett Designs will make every effort to complete the project/changes in the given time frame. Reasonable delays are accepted if functionalities are redefined or modified.
    7. Any delays at the client’s end may delay the project and proposed timeframes and incur additional costs.
    8. Any bugs (programming errors) reported during development do not attract additional charges.
    9. Any re-work on an already completed task can attract additional charges. Any changes in the design after the design approval will incur additional charges.
    10. Any modifications requested after the Go-Live approval will incur additional charges. All extra work, over and above the estimates, is charged separately.
    11. Website/application content and all related materials must be provided to us before starting the project.
    12. Our websites/applications are generally tested on PCs, tablets, and some mobiles, including near-recent versions of the following browsers: Edge & Chrome. Please let us know if you require testing on any other browser.
    13. Responsive/multi-device compatible web pages are tested on iPhones and iPads. If you require testing on any other device, please discuss it in advance.
    14. If your website/application is not hosted on an Morfett Designs server, additional hours that may be required due to a server or network-related issue are not covered in our quotes and may be charged separately.
    15. Morfett Designss software codes (not including open-source software) are copyrights of Morfett Designs. The codes can be handed over at an additional cost for use once all previous invoices are settled, on the condition that the codes are used only for use or modification
      for re-use for further development for the specified client or subsequent owners of that legal entity. Under no circumstance will the codes be allowed to be used for re-selling or duplication purposes.
    16. The website or software application will be designed to be deployed on the web using a commercial-grade web server or a similar setup. Based on your website traffic, the website may not perform if deployed on a generic office network environment.
    17. Due to the functionalities required, there will be 3rd party components such as Third-Party Payment Gateways (Paypal & Stripe) or SSL certificates involved in building a website/application. Although Morfett Designs does its best to recognize the suitability of any such component, any unforeseen limitations of 3rd party components are beyond our control. Our quotes do not include third-party component purchase costs (such as SSL, Payment gateways, Plugin licenses, etc.).
    18. Morfett Designs takes no responsibility for open-source products or integrations such as WordPress, WooCommerce, Mailchimp, etc. It is the client’s responsibility to update all components and third-party software. We suggest you take regular backups to avoid disruptions and will actively help on this as part of a separate support agreement.
    19. Morfett Designs offers packages in coordination with third-party providers. Changes to the third-party provider’s rules and policies may ultimately affect our services or the terms and conditions herein.
    20. The client must recognize that unforeseen circumstances may delay the development process, particularly regarding the integration of third-party software. We will try our best to complete the project as agreed in the proposal. As long as it is within a reasonable period, the client agrees not to penalize us for any genuine delay when we make every effort to keep the project on the proposed schedule.
    21. Domain registration/renewal etc., charges are not included as a part of any project/proposal unless mentioned otherwise. If required, a quote will be submitted separately and approved by the client.
    22. Hosting charges are not included in the quotations unless mentioned otherwise. Morfett Designs can organize an appropriate hosting solution if required. When clients decide to manage their Hosting, we should be consulted before finalizing the type of Hosting and database, as it should meet the requirements of the technology used for the development. Please note that we’ll require full access with hosting support for testing and deploying the application. Morfett Designs will not be liable for any delays or errors caused by direct or indirect actions of the hosting company.
    23. Morfett Designs generally builds and tests the websites/applications on our servers or hosted domains. Morfett Designs cannot give access to their test servers and test websites to the clients or any third party. The website/application can be transferred to a nominated 3rd party server upon full payment of all invoices and dues.
    24. All communications/correspondences are generally done via email. It is the client’s responsibility to keep us updated with their relevant email addresses.
    25. Any imagery supplied by Morfett Designs is for placeholder purposes and, unless stated otherwise in writing & may be subject to copyright.
    26. Fair usage of our server space (including email accounts) is expected; uploading high-resolution images & videos to your site may incur further hosting costs.
    27. Website maintenance performed on 3rd party hosting is not covered by backups & therefore, errors that occur during this process are not covered in the hourly rate; we recommend a backup fee of £100 to be paid to cover this eventuality.
    28. Any assets or projects that fail payment, whether individual or under the guise of one company account (groups & partnerships) may lead to the suspension and, ultimately, cancellation of all services provided with additional re-activation charges & late payment fees.
    29. Client agrees to reimburse Morfett Designs for any additional expenses necessary to complete the work. Examples would be the purchase of unique fonts, stock photography, etc.
    30. All Morfett Designs services may only be used for lawful purposes. You agree to indemnify and hold Morfett Designs harmless from any claims resulting from your use of our service that damage you or any other party.
    31. Any payments made under a payment plan are non-refundable (including initial 1st payment deposit) No interest is charged; however, late payment may incur a late payment fee of 5%.
    32. A link to Morfett Designs will appear in either a small type or a small graphic at the bottom of the client’s website. If a graphic is used, it will be designed to fit in with the overall site design. The client also agrees that the website developed for the client may be presented in Morfett Designs’s portfolio. This is an essential inquiries generator for us as a small design business; a fee of £500 can be paid to remove this.
    33. Morfett Designs cannot accept responsibility for any alterations caused by a third party occurring to the client’s pages once installed. Such alterations include, but are not limited to, additions, modifications, or deletions.
    34. These Terms and Conditions supersede all previous representations, understandings, or agreements. The client’s signature, verbal or written consent to proceed or payment of an advance fee constitutes agreement to and acceptance of these Terms and Conditions.
    35. Automatic Translation on websites can incur additional monthly costs, as we have no way to predict the levels of traffic your website will receive upon “go live” we cannot predict these costs in advance; most of our clients do not exceed the threshold of Google’s complimentary allowance; however, if you have high levels of traffic this may occur, to date our highest traffic site costs around $250-300 per month, please allow for this in your forecasting when using this service, the good news is that more money spent on translations the more visitors you have!
    36. During the migration of any digital services, Morfett Designs cannot be held liable for the loss of data, service, or unexpected downtime.
    37. We will honor the invoice sent & paid for three months from inception; after 90 days, we reserve the right to increase fees in line with inflation & business practices or cancel the web build project. (all costs will be lost)
    38. Any estimates provided, whether verbal or written, are valid for a maximum of 30 days.
    39. Monthly maintenance plans are the purchase of “hours” of amendments & general updates; the time purchased expires after 30 days. Hours are non-transferable, non-refundable, and cannot be exchanged for cash or physical products, including hosting fees or other services. No change or certificate for unused differences can be issued.
    40. Mobile Responsivity is a readability process & not a separate design process; changes on mobile may be made due to the nature of size & aspect ratio on-screen.
    41. All marketing is run on Morfett Designs systems, and the logins or access is not shared with clients or 3rd parties; data, setup & tracking belong to Morfett Designs and will not be transferred or shared with any 3rd parties.
    42. On some web builds, we use licenses from 3rd parties; if these need updating, the update fee will be payable by that client; if a client leaves Morfett Designs, licenses for themes & multi-user plugins are not transferred with the build, they remain the property of Morfett Designs.
    43. All subscriptions &/or retainers are subject to 90 days cancellation notice.
    44. All content written by Morfett Designs is the property of Morfett Designs unless explicitly noted otherwise. This includes Social Media, Websites, and Email Campaigns (this is not an exhaustive list); the content we write can be re-sold or re-branded for multiple users.
    45.  All designs whether digital or physical are subject to 3 revisions as standard, any amendment to this must be provided in writing by Morfett Designs.
    46. If any outstanding invoices are overdue by more than 70 days, they will be passed to our debt collection agency & their fees.
    47. a. **Limitation of Liability for Social Media Content** Morfett Designs, its affiliates, employees, agents, and representatives (collectively “the Company”) are not liable for the content of any posts, updates, comments, or any other type of content (“Content”) published on any social media platforms.
      b. **Responsibility of the Account Owner** The owner of the social media account, our client (“the Account Owner”) bears the sole responsibility for reviewing and ensuring the accuracy, appropriateness, and legality of the Content once it is live on any social media platform. It is the Account Owner’s obligation to immediately notify Morfett Designs of any discrepancies, inaccuracies, concerns, or issues related to the Content.
      c. **Rectification** In the event that the Account Owner identifies any issues or inaccuracies with the Content, it is the Account Owner’s responsibility to promptly inform the Morfett Designs. Morfett Designs will make reasonable efforts to address and rectify the stated concerns in collaboration with the Account Owner. However, Morfett Designs does not guarantee any specific outcomes or time-frames for such rectifications.
      d. **Indemnification** The Account Owner agrees to indemnify, defend, and hold harmless Morfett Designs from any and all claims, liabilities, damages, costs, and expenses, including reasonable attorney’s fees, arising out of or related to the Content, the Account Owner’s use of the Content, or any breach of these Terms & Conditions.
    48. All design work created by Morfett Designs, including but not limited to logos, branding, marketing materials, and website designs, is provided in final deliverable formats as agreed upon with the client. Raw design files, including but not limited to Adobe Photoshop (PSD), Illustrator (AI), InDesign (INDD), Sketch, or Figma files, are not included in any purchase. These files remain the intellectual property of Morfett Designs and will not be shared, transferred, or sold unless explicitly agreed upon in writing and subject to an additional fee.
    49. Turnaround Times
      We aim to complete standard requests within approximately 72 hours. However, turnaround times may vary depending on current workload, project complexity, or any required sourcing or third-party input. Where delays are anticipated, we will advise accordingly.

Where a retainer is in place:

Payment Terms

Clients must commit to a 12-month retainer with monthly prorated payments.
Payments are processed via direct debit and must be made on time.
Late or missed payments will incur a 5% charge.
Failure to pay on the due date will result in the suspension of all work.

Content Ownership & Rights

Morfett Designs retains full ownership of all content created, including intellectual property rights.
Clients do not have access to raw materials (e.g., original video footage, design files, or unedited content).
In the event of early contract termination, Morfett Designs retains all rights to content until the full 12-month retainer is completed.
Upon successful completion of the 12-month term, clients may use the edited content; however, raw content remains the property of Morfett Designs.
Clients may not edit, modify, or repurpose content outside the agreed terms.
Intellectual property rights, including copyrights and trademarks, remain with Morfett Designs unless explicitly transferred through a separate agreement.

Creative Control & Revisions

Morfett Designs retains full creative control over content ideas, filming, and editing.
Clients must pre-approve the content strategy before filming.
One revision per piece of content is included.
Additional revisions are chargeable at £150 per hour.

Content Scheduling & Indemnification

Clients are responsible for checking scheduled content via the scheduling section of each social platform.
Content is scheduled weekly.
Morfett Designs accepts no liability for errors or indemnification claims related to posted content.
Clients remain responsible for checking scheduled content, responding to direct messages (DMs), handling sales, and managing bookings.

Shoot Cancellations

Shoot days must be scheduled at least three months in advance.
Cancelled shoot days cannot be rescheduled or refunded.
A cancelled shoot results in the loss of that shoot day.

Software & Storage

The monthly retainer includes software subscriptions such as Photoshop, Adobe Express, Final Cut Pro, and cloud-based storage.
Media storage is provided for 12 months; raw footage is deleted after this period.
Upon cancellation, raw files will be stored for 30 days before permanent deletion.
Clients are responsible for backing up completed content, which will be shared via Google Drive.
Morfett Designs is not responsible for storage failures or data loss.

Confidentiality

Both Morfett Designs and the client agree to keep all sensitive business information confidential.
Any shared data, strategies, or insights must not be disclosed to third parties without written consent.
Content strategies remain the intellectual property of Morfett Designs.

Promotional Use

Morfett Designs reserves the right to share client content on its social media channels for promotional purposes.

Termination Clause

Clients must provide 90 days’ written notice for early termination to recoup any shoot fees, editing fees, or content strategy hours.
If termination occurs before the 12-month period, all content remains the property of Morfett Designs.
No refunds will be issued for early termination.

Limitation of Liability

Morfett Designs is not liable for indirect, incidental, or consequential damages resulting from its services.

Force Majeure

Morfett Designs is not responsible for delays or service failures due to unforeseen events such as natural disasters, pandemics, government restrictions, or other circumstances beyond reasonable control.

Dispute Resolution

Any disputes shall first be resolved through good-faith negotiations.
If unresolved, disputes will be settled through mediation or arbitration before pursuing legal action.

Client Communication

Clear client communication is essential.
Clients are responsible for scheduling filming days and providing timely feedback.

Severability

If any part of these terms is deemed invalid, the remaining provisions shall remain in effect.

By engaging Morfett Designs’ services, clients agree to these Terms & Conditions. Any violation may result in service suspension or contract termination.

Payment Default and Early Termination

Where Morfett Designs provides services subject to a minimum contractual term, including but not limited to any monthly retainer, partnership arrangement, or bundled service offering, the Client acknowledges and agrees that the minimum term constitutes a binding, non-cancellable commitment for the full duration of the agreed term.

The Client shall not be entitled to terminate, suspend, or exit the agreement prior to expiry of the minimum term. In the event that the Client seeks to terminate the agreement early, or is deemed to be in material breach of these terms, all fees due for the remainder of the minimum term shall become immediately due and payable in full. This shall include, without limitation, any outstanding monthly retainer fees, discounted services, and any services described as complimentary, gifted, or provided free of charge as part of the overall commercial arrangement.

Without prejudice to any other rights or remedies available to Morfett Designs, any retainer payment that remains unpaid for a period exceeding thirty (30) days from its due date shall constitute a material breach of contract. Such breach shall be treated as an early termination by the Client and shall automatically trigger immediate acceleration of all remaining fees due for the balance of the minimum term.

Any services, websites, designs, content, or deliverables provided at no charge or at a discounted rate are strictly conditional upon full completion of the minimum term and full settlement of all sums due. Upon early termination or payment default, any such discounts or complimentary services shall be automatically revoked and shall become chargeable at Morfett Designs’ full standard rates.

No intellectual property rights, ownership, licence, or usage rights in respect of any work produced by Morfett Designs shall transfer to the Client unless and until all outstanding sums have been paid in full and cleared. Morfett Designs expressly reserves the right to suspend access to, disable, withdraw, or recall all works and deliverables in the event of early termination or payment default.

Payment of any invoice issued by Morfett Designs shall constitute full acceptance of the minimum term, payment structure, and the provisions of this clause.

Intellectual Property and Continued Use

All intellectual property rights, including copyright, design rights, and all related rights, in any branding, designs, creative assets, websites, content, or materials produced by Morfett Designs shall remain the sole property of Morfett Designs unless and until expressly assigned to the Client in writing following full payment of all sums due.

Any licence granted to the Client to use such materials prior to full payment shall be strictly temporary, revocable, and conditional upon full compliance with the payment terms and minimum contractual term.

In the event of early termination or payment default, including any retainer payment remaining unpaid for more than thirty (30) days, any licence to use the works shall automatically terminate with immediate effect. The Client shall immediately cease all use of the materials and remove them from all platforms, publications, and media.

Continued use of any materials following termination of the licence shall constitute unauthorised use and infringement of Morfett Designs’ intellectual property rights.

Photography & Videography Ownership and Usage

Unless otherwise agreed in writing, all photography, videography and other media created by Craig Morfett Design S.L. remain the exclusive intellectual property of Craig Morfett Design S.L.

Clients are commissioning and paying for the creation of marketing content to be used by Craig Morfett Design S.L. in the delivery of the agreed social media, marketing or advertising services. The fee paid is for the production and use of such content within those services and does not constitute the purchase, transfer or assignment of ownership, copyright or any other intellectual property rights.

RAW files, original footage, project files and unedited media are not supplied under any circumstances and remain the sole property of Craig Morfett Design S.L.

Clients are not granted access to our internal media library, cloud storage or asset management systems. Only edited content selected and published by Craig Morfett Design S.L. as part of the agreed services will be provided or made available where expressly agreed.

Should a client wish to purchase specific edited media or negotiate a separate commercial licence for use outside the agreed services, this may be arranged at Craig Morfett Design S.L.’s sole discretion and will be subject to a separate written agreement and additional fees.

Licence Upon Termination

Any licence granted to the client to use content created by Craig Morfett Design S.L. is limited to the duration of the agreed marketing, social media or advertising services.

Upon termination or expiry of those services, all rights granted to the client to use such content shall automatically cease unless otherwise agreed in writing or unless the client has separately purchased a perpetual licence or ownership rights for specific media.

Craig Morfett Design S.L. reserves the right to require the removal of its content from the client’s websites, social media channels, advertising campaigns, printed materials and any other marketing platforms following termination of the agreement where no continuing licence has been granted.

Nothing in this agreement shall transfer ownership of any copyright, intellectual property or underlying media to the client unless expressly stated in a separate written agreement signed by both parties.
